Justice in India: Overburden and Injustice Written by Ashok Raina
 
In India, a country with the largest population of 140 crore, the judicial process and getting justice are two identical terms which everyone finds easy to explain, but if a person who has entered the field of fighting for justice is asked to speak on this subject, then a new definition can be expected to come out of his mouth on the subject of " The battle for justice to get it in India is very difficult "

You know perfectly that there are at least 25 Honorable High Courts and Supreme Court alongside with other lower courts working for the welfare of the people in India with intention and purpose to provide in favor of them. It is unfortunate to say here that people in our own country are facing unnecessary troubles and have to knock on the doors of courts to seek justice.

In the light of atrocities and injustice being done to our own citizens in India, hundreds of thousands of cases are pending for settlement or resolution in the judicial and non-judicial courts across the country and if we see in the right manner then we will able to understand quickly that for all the situations the executive power of authorities are actually answerable and are responsible for developing such creations against the humanity by adoption of inhumanity ways of behavior against its own people in one pretext to another for to constraints them to move to the judicial courts.

In India, today every person has to resort to the courts in view of the deteriorating working of the executive power of the authority day by day, due to which it has become difficult to fix a time limit to get justice successfully as countless cases are pending in the courts at present.

The second important thing is that with the growing corruption in the country, the time limit for the fight for justice is getting extended and more time is wasted. This is the reason why many citizens are spending centuries waiting for justice. Not only this but Sometimes the truth is being trampled upon and the corrupt bureaucracy is moving ahead to make the untruth win by misleading the judiciary by submitting the false affidavits and succeeding by making overrule influence approach against those who plead for justice based on truth are being humiliated even after going around the courts.

No one can deny this fact, however if any employee working under the judiciary is asked whether it is true that thousands of cases under Articles 14, 15, 16, 17, 18, 19, 19(1)(a), 21 and 226 come up for hearing every day in most courts of India, they will say the same thing as I have claimed that for the last more than 77 years we have been unable to implement equal rights despite being independent. It is also not out of place to say here that the executive powers usually violate the law by taking it in their own hands and later refuse to implement even the directions given by the courts and forcing the citizens to file the contempt proceedings against the concerned executive powers and still aftermath they are doing efforts to get rid of from the clutches of law and as such the battle being fought against injustice in India is not as easy as an ignorant person might think.

Countries like India where appointments through the backdoor are often challenged in the courts and due to which many talented unemployed youths are left disappointed throughout their lives. The important thing is why appointments are being made through the backdoor of blue-eyed persons or of highly rich of influenced of political cum nonpolitical persons and why do candidates have to knock the doors of courts for this and then moments pass into hours and hours into days and days into years but still justice can never be expected from the executive power of authority in a positive way. The condition of people who go in search of justice in India becomes worse everywhere by means of time, investment of capital and disappointment.

Centuries passed and laws were made in both Houses of parliament or state assemblies but I did not see even a single law being implemented and even if I did see it, it was only in the legal books kept on the shelves in the lawyers' chambers. Finally, I came up with this foundation that in India where justice is often delayed — and too frequently denied — the Justice in India is overburdened and unjust.
